TERMS & CONDITIONS

In these terms and conditions, “we” “us” and “our” refers to Elepantsy Creations. Your access to and use of all information on this website including purchase of our product/s is provided subject to the following terms and conditions. The information is intended for residents of the United Kingdom only. We reserve the right to amend this notice at any time and your use of the website following any amendments will represent your agreement to be bound by these terms and conditions as amended. We, therefore, recommend that each time you access our website you read these terms and conditions.

SHOPPING

You can order products online via www.elephantsycreations.com. When you place an order for a product you are offering to buy it for the price stated. We will send you an order acknowledgement by email. We may refuse to accept an order if;

To register with the website and shop you must be over 18 years of age
We do not receive your payment
There has been a pricing, discount offer or products description error
The ordered products are out of stock or discontinued
Personalised products contain content that may cause annoyance or inconvenience such as indecent, offensive, racist, pornographic, etc.

In any refusal, we will immediately refund your purchase for the total amount debited where you have been charged.

Import duties & taxes may apply upon receipt of international orders.

Duties & taxes are set by the Customs Authority of the destination country. Therefore, it will be your responsibility to pay these charges if and when asked by authorities.

Discount codes cannot be used when purchasing sale items, may exclude certain items and for a limited time only.

Our return policy does not apply to the refusal of delivery, return of delivery, items that have been personalised or custom made for you.

BESPOKE ORDERS

When placing a bespoke order with us with a logo/text/phrase/slogan, etc., you agree to us publishing images of your finished item(s) on our website and for advertising purposes. You always have the right to request that we take down such materials at any point or not to publish them in the first place when placing the order. If such a request is made, we will take it down within 2 to 3 working days; however, we cannot recall any already distributed items.

PAYMENT

You must pay for your order before it is delivered and you can do so by credit card, debit card or through Apple Pay.

AVAILABILITY

We try to keep our site as up to date, however, we can not guarantee that all our products will always be in stock. If an item is out of stock we will aim to deliver within 30 days. If we cannot dispatch an item to you within the 30 days you can request a cancellation and we will cancel the order and refund your money in full.

ORDER CANCELLATIONS

If you wish to cancel your order you can notify us by contacting our customer services.

You cannot cancel your order if the product is personalised, or custom made to your requirements.

Due to the nature of our products, they are immediately sent for production. Please check your order during the order process and the confirmation email carefully as we cannot refund or cancel your order for personalised products which have been misspelt or you have had a change of heart.

Please note that we do not proofread or check personalisation due to automated system and product may come blank or with fixed design or fixed text if you do not enter any personalisation.

DELIVERY

We deliver to destinations within UK. We will deliver the goods ordered by you to the address that you give us during your order process. We endeavour to dispatch goods within 7-10 working days however, we cannot guarantee dispatch on that day or accept liability for deliveries made outside specified lead times. We also cannot accept liability or costs incurred due to failed or delayed deliveries where goods are sent directly from our manufacturers or for delays in the delivery caused by any third party. Dispatch times shown on the product description pages are indicative only, may vary during peak times or if the item is out of stock.

Orders will be dispatched with our chosen delivery method. If you do not receive your order within 30 days from the ordered date, we do not take liability unless you notify us by email within 30 days from the order date.

IMPORTANT NOTE:

Our working hours are Monday - Friday 8am - 5.00pm and all our dispatch and delivery timescales do not include weekends or bank holidays. Next Working Day delivery to Northern Ireland, Overseas UK addresses and Parts of Scotland will take an extra day.

2nd Class Mail UK address only - Royal Mail aim to deliver within 5-7 working days, however, this is not guaranteed by Royal Mail.
1st Class Mail UK address only- Royal Mail aim to deliver your order 3-5 working days, however, this is not guaranteed by Royal Mail.
Express & Tracked UK address only - Royal Mail aim to deliver your order 1-3 working days, however, this is not guaranteed by Royal Mail.
Next Working Day - Orders received by the cut off time stated on the product page, will be delivered next working day (Excludes Northern Ireland, Overseas UK addresses and Parts of Scotland).

Please note that all our items require production time and above delivery timescales are estimated.

RETURNS

We do not except returns due to items being personalised.

LIABILITY

To the full extent permitted by law, our liability for breach of an implied warranty or condition is limited to the supply of the goods and/or services again or payment of the costs of having those goods and/or services supplied again. We accept no liability for any loss whatsoever including consequential loss suffered by you arising from product/s we have supplied.

DISCLAIMERS

We endeavour to ensure all information on our Website is correct, however, we do not warrant the accuracy and completeness of this. We may make changes to any information, products, descriptions and prices on our website, at any time without notice. The information and material on our Website may be out of date, and we make no commitment to update. Whilst we have taken all due care in providing the information on our website, we do not provide any warranty either express or implied including without limitation warranties of title or implied warranties of merchantability or fitness for a particular purpose. To the extent permitted by law, any condition or warranty which would otherwise be implied into these terms and conditions is excluded. We also take all due care in ensuring that our website is free of any virus, worm, Trojan horse and/or malware, however, we are not responsible for any damage to your computer system which arises in connection with your use of our website or any linked website.

INDEMNITY

By accessing our website, you agree to indemnify and hold us harmless from all claims, actions, damages, costs and expenses including legal fees arising from or in connection with your use of our website or products.

JURISDICTION

These terms and conditions are to be governed by and construed in accordance with the laws of England and any claim made by either party against the other which in any way arises out of these terms and conditions will be heard in England and you agree to submit to the jurisdiction of those Courts. If any provision in these terms and conditions is invalid under any law the provision will be limited, narrowed, construed or altered as necessary to render it valid but only to the extent necessary to achieve such validity. If necessary the invalid provision will be deleted from these terms and conditions and the remaining provisions will remain in full force and effect.
